Lisa K. was a passenger in a 1993 Mazda Protégé that was traveling westbound on US 12. A USF tractor-trailer was traveling eastbound on US 12. The tractor-trailer failed to yield and turned left into the path of the vehicle in which Lisa was a passenger, colliding with the vehicle. Lisa suffered a spinal cord injury in the crash rendering her permanently paraplegic.
Who do you feel is at fault?
Dale Gilchrist, for whom USF Holland and USFreightways Corp. were vicariously liable, for failing to yield and making a left turn into oncoming traffic. USF Holland and USFreightways Corp. are also at fault for their failure to properly train, test, and supervise Gilchrist and failure to ensure his compliance with safety regulations.
